Terms of Service

These Terms of Service ("Terms") govern your access to and use of FacelessTube, a product of AI Venture Holdings LLC ("Company," "we," "us," or "our"). By creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using FacelessTube on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and the term "you" refers to that organization.

If you do not agree to these Terms, do not create an account or use FacelessTube.

You must be at least 18 years old to use FacelessTube. If you are under 18, you may not create an account or use the service.

By using FacelessTube, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

You must notify us immediately at legal@facelesstube.com if you suspect unauthorized access to your account.

You may not share your account with others or allow others to access FacelessTube through your account.

FacelessTube offers a free plan and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis, as selected at checkout.

Auto-renewal. Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method for all applicable fees. We will notify you by email at least 7 days before any material price change takes effect.

Cancellation. You may cancel your subscription at any time from the Billing section of your account Settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. We do not prorate refunds for partial billing periods.

Refunds. We do not offer refunds for subscription fees already paid, except as required by applicable law or as described in Section 4.1. If you believe you were charged in error, contact legal@facelesstube.com within 30 days of the charge.

Section 4.1 - Statutory refund rights. If you are located in the European Union, you have a 14-day statutory right of withdrawal from the date of purchase. This right does not apply once you have begun using the service (e.g., generated images or used premium features). By using the service, you expressly waive this right.

Failed payments. If a payment fails, we will attempt to retry the charge and notify you by email. If the payment issue is not resolved within 7 days, we may downgrade your account to the free plan.

You may use FacelessTube only for lawful purposes and in accordance with these Terms. You agree not to:

Use the service to generate content that is illegal, harassing, defamatory, obscene, or that infringes any third-party intellectual property rights.

Attempt to reverse engineer, decompile, or extract source code from the platform.

Circumvent any rate limits, access controls, or security measures.

Use the service to scrape, collect, or resell data about YouTube channels for purposes other than operating your own channel strategy.

Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Violate the terms of service of any third-party API or platform we integrate with, including YouTube/Google APIs and Stripe.

FacelessTube and its original content, features, and functionality are owned by AI Venture Holdings LLC and are protected by copyright, trademark, and other intellectual property laws.

AI-generated content. Images generated using FacelessTube are produced using fal.ai Flux. You retain ownership of the output content subject to the terms of fal.ai's usage policies. We grant you a non-exclusive license to use generated content for your YouTube channel and related commercial purposes.

You grant us a limited license to store and process the content you submit (prompts, channel data, scripts) solely to provide the service.

FacelessTube integrates with third-party services including YouTube/Google (data API), fal.ai (image generation), Stripe (payments), and Supabase (infrastructure). Your use of these services is also governed by their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services. Disruptions to third-party APIs may affect the availability of certain FacelessTube features.

FacelessTube is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free from harmful components. We do not warrant that any particular result will be achieved through the use of FacelessTube, including but not limited to YouTube channel growth, revenue, or algorithmic performance.

To the maximum extent permitted by applicable law, AI Venture Holdings LLC and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or related to your use of FacelessTube.

Our total cumulative liability for any claims arising out of or related to these Terms or the service will not exceed the greater of (a) the amount you paid to us in the 12 months before the claim arose, or (b) $100 USD.

Some jurisdictions do not allow certain limitations on liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless AI Venture Holdings LLC from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of FacelessTube, your violation of these Terms, or your infringement of any third-party rights.

You may delete your account at any time from the Settings page. Deletion is permanent and immediate; we cannot recover deleted account data.

We may suspend or terminate your account at any time if we determine that you have violated these Terms, engaged in fraudulent activity, or posed a risk to the security or integrity of the platform. We will generally provide notice unless we determine that immediate termination is necessary to protect the service or other users.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Informal resolution. Before initiating formal proceedings, you agree to contact legal@facelesstube.com and attempt to resolve any dispute informally for at least 30 days.

Arbitration. If informal resolution fails, you and the Company agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis; class arbitrations and class actions are not permitted.

Small claims exception. Either party may pursue claims in small claims court if the dispute qualifies.

EU/EEA users. If you are located in the EU/EEA, the mandatory consumer protection laws of your country of residence apply and may override certain provisions above, including the arbitration clause.

Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

We may update these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the site at least 14 days before the changes take effect.

Your continued use of FacelessTube after the effective date of updated Terms constitutes your acceptance.
